Terms and Conditions

Welcome to Morgan Cost Management. By accessing our website, requesting a project quote, or using our construction estimating and planning services, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before submitting your project drawings or specifications.

1. Scope of Professional Services

Morgan Cost Management provides professional construction estimating, quantity surveying, and project management support services, specifically including:

  • Civil Takeoffs: Earthwork, site utilities, grading, paving, and land development quantities.

  • Concrete Takeoffs: Rebar, formwork, slab/foundation volumes, and structural concrete estimation.

  • MEP Takeoffs: Mechanical, Electrical, and Plumbing quantity takeoffs and fixture/equipment breakdowns.

  • GC (General Contracting) Takeoffs: Full-scope trade takeoffs, preliminary budgets, and commercial/residential cost estimations.

  • Project Scheduling: Critical Path Method (CPM) scheduling, project timelines, and baseline schedules for bid planning.

2. Estimating & Scheduling Disclaimer

  • Opinion of Probable Cost: All quantity takeoffs, cost estimates, and schedules provided by Morgan Cost Management are professional opinions based on industry expertise and the drawings supplied.

  • Market Variations: Actual material prices, labor rates, equipment availability, and field conditions are subject to local market fluctuations and unforeseen site factors beyond our control.

  • No Guarantee of Bid Outcome: Our estimates and schedules are designed to assist clients in preparing competitive bids. We do not guarantee that using our reports will result in winning a bid, securing a contract, or achieving specific profit margins.

3. Client Responsibilities & Plan Submissions

  • Complete Documents: Clients are responsible for providing complete, legible, and current sets of blueprints, architectural drawings, engineering plans, addenda, and project specifications.

  • Omissions & Errors: Morgan Cost Management is not liable for errors or quantity discrepancies arising from incomplete, contradictory, or ambiguous drawings provided by the client.

  • Scope Changes & Addenda: Any plan revisions, design modifications, or additional addenda submitted after project estimation has begun may require additional fee adjustments and revised delivery schedules.

4. Project Turnaround & Delivery

  • Delivery timelines are established upon reviewing project scope and scale.

  • While we make every effort to meet all bid deadlines, delivery dates are target estimates. Morgan Cost Management is not responsible for delays caused by late client responses, missing drawing sets, or technical disruptions.

5. Payment Terms & Refund Policy

  • Payment Terms: Invoices must be settled in full according to the proposal terms before final estimate spreadsheets, takeoff markups, or CPM scheduling files are released.

  • Non-Refundable Policy: Due to the customized and labor-intensive nature of construction estimating and scheduling, payments are strictly non-refundable once work on a project has commenced.

  • Discrepancy Review: If you notice a factual discrepancy in your takeoff report or schedule, you must notify us within seven (7) business days of delivery for review and adjustment.

6. Confidentiality & Intellectual Property

  • Strict Confidentiality: All bid documents, project blueprints, specifications, and client contact information are handled with 100% confidentiality. We never share or disclose your bid files to third parties or competing contractors.

  • Usage Rights: Upon full payment, the client receives a non-exclusive, internal license to use the delivered takeoff reports, estimates, and schedules for their project bidding and management.

7. Limitation of Liability

  • To the maximum extent permitted by law, Morgan Cost Management shall not be held liable for any direct, indirect, incidental, or consequential damages (including lost profits, lost contract bids, or project delay costs) resulting from the use of our takeoff estimates or scheduling files.

  • Total liability for any claim shall strictly not exceed the total fee paid by the client for that specific estimating service.

8. Changes to Terms

Morgan Cost Management reserves the right to update or modify these Terms & Conditions at any time. Updated versions will take effect immediately upon being posted on our website.
